Welcome to InstaTracker. These Terms of Use ("Terms") govern your access to and use of the InstaTracker mobile application ("App," "Service," or "InstaTracker"). By downloading, installing, or using InstaTracker, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using InstaTracker, you confirm that:

• You are at least 13 years of age (or the minimum age required in your jurisdiction)
• You have the legal capacity to enter into these Terms
• You will comply with all applicable local, state, national, and international laws
• You have read and understood our Privacy Policy
• You accept and agree to be bound by these Terms in their entirety

2. Description of Service

InstaTracker is a mobile application that provides the following features:

• User Tracking: Monitor Instagram users' following and unfollowing activities
• Real-Time Notifications: Receive alerts when tracked users follow or unfollow accounts
• Activity History: View detailed timelines of tracked users' Instagram activities
• Multiple Profile Monitoring: Track multiple Instagram profiles simultaneously
• Background Monitoring: Automatic activity checks without manual intervention

InstaTracker accesses publicly available information on Instagram through their platform. We are not affiliated with, endorsed by, or sponsored by Instagram, Meta Platforms, Inc., or any of their subsidiaries.

3. User Responsibilities

3.1 Account Requirements

To use InstaTracker, you must:

• Have a valid Instagram account in good standing
• Provide accurate login credentials when prompted
• Maintain the security of your Instagram account
• Comply with Instagram's Terms of Service at all times
• Be responsible for all activities that occur under your account

3.2 Acceptable Use

You agree to use InstaTracker only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal activities or purposes
• Violate any local, state, national, or international law
• Infringe upon or violate intellectual property rights of others
• Harass, abuse, stalk, threaten, or otherwise violate the legal rights of others
• Impersonate or attempt to impersonate any person or entity
• Interfere with or disrupt the operation of the App or servers
• Attempt to gain unauthorized access to any portion of the App
• Use the App to collect or store personal data about other users without their consent

3.3 Session Security

You are solely responsible for:

• Maintaining the confidentiality of your Instagram session credentials
• Securing your device with appropriate passwords or biometric locks
• Any activities that occur through your InstaTracker session
• Notifying us immediately of any unauthorized access to your account

4. Prohibited Uses

4.1 Harassment and Stalking

You may NOT use InstaTracker to:

• Harass, stalk, or intimidate any individual
• Monitor individuals without a legitimate purpose
• Collect information for malicious purposes
• Engage in any form of cyberbullying or online harassment

4.2 Violation of Instagram's Terms

You may NOT:

• Violate Instagram's Terms of Service, Community Guidelines, or policies
• Engage in automated or scripted activity that violates Instagram's rate limits
• Use the App in ways that could get your Instagram account banned or restricted
• Access Instagram data that violates their API usage policies

4.3 Automated Abuse

You may NOT:

• Use bots, scripts, or automated systems in conjunction with InstaTracker
• Attempt to circumvent any limitations or restrictions on the App
• Engage in spam or other forms of unsolicited communication
• Create multiple accounts to evade restrictions or bans

4.4 Reverse Engineering

You may NOT:

• Reverse engineer, decompile, or disassemble the App
• Modify, adapt, or create derivative works based on InstaTracker
• Remove or alter any proprietary notices or labels
• Attempt to extract source code from the App

5. Instagram API Usage and Compliance

InstaTracker utilizes Instagram's platform to provide its services. You acknowledge and agree that:

• Instagram's Terms Apply: Your use of InstaTracker is subject to Instagram's Terms of Service, which you must comply with at all times
• No Affiliation: InstaTracker is not created by, affiliated with, or endorsed by Instagram or Meta Platforms, Inc.
• API Limitations: Instagram may impose rate limits, restrictions, or changes to their API that could affect InstaTracker's functionality
• Data Access: We only access data that is publicly available or that you have authorized us to access through your Instagram account
• Service Changes: Instagram may modify or discontinue APIs or features at any time, which may impact InstaTracker's capabilities

6. Intellectual Property Rights

6.1 InstaTracker's Rights

InstaTracker and its original content, features, and functionality are owned by InstaTracker and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You acknowledge that:

• All rights, title, and interest in InstaTracker remain with us
• You receive no ownership rights by using the App
• Our trademarks and trade dress may not be used without written permission
• Any feedback or suggestions you provide may be used by us without compensation

6.2 Instagram's Rights

Instagram, its logos, and related marks are trademarks of Meta Platforms, Inc. You acknowledge that:

• All Instagram content accessed through InstaTracker remains the property of Instagram and its users
• You must respect all copyright and intellectual property rights in Instagram content
• InstaTracker does not grant you any rights to Instagram's intellectual property

6.3 User-Generated Content

Any content you create within InstaTracker (such as notes, tags, or annotations) remains your property. However, you grant us a limited license to store and display this content as necessary to provide the Service.

7. Limitation of Liability

7.1 "As Is" Service

InstaTracker is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free operation

7.2 No Guarantees

We do NOT guarantee that:

• The App will always be available or accessible
• All tracked activity data will be accurate or complete
• The App will be free from bugs, viruses, or other harmful components
• Defects will be corrected in a timely manner or at all
• The Service will meet your specific requirements or expectations

7.3 Limitation of Damages

To the maximum extent permitted by law, InstaTracker and its affiliates, officers, directors, employees, agents, and licensors shall NOT be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Loss of goodwill or reputation
• Service interruptions or data loss
• Cost of substitute services
• Any damages arising from your use or inability to use the App

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not we have been advised of the possibility of such damages.

7.4 Maximum Liability

In jurisdictions that do not allow the exclusion or limitation of liability, our total liability to you for all claims arising out of or related to the App or these Terms shall not exceed the amount you paid us (if any) in the six (6) months prior to the event giving rise to the liability.

8. Indemnification

You agree to indemnify, defend, and hold harmless InstaTracker, its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to:

• Your violation of these Terms or any applicable law
• Your violation of any rights of another person or entity
• Your misuse of the App
• Your violation of Instagram's Terms of Service
• Any content you submit, post, or transmit through the App

9. Service Availability and Changes

9.1 Service Interruptions

InstaTracker may be temporarily unavailable due to:

• Scheduled maintenance or updates
• Instagram API issues or rate limiting
• Technical difficulties or server problems
• Force majeure events beyond our reasonable control

We will make reasonable efforts to notify users of planned maintenance, but we are not obligated to do so.

9.2 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any feature or functionality of the App at any time
• Change the pricing structure (if applicable) with reasonable notice
• Implement new features or remove existing features
• Update the App to comply with legal requirements or Instagram's policy changes

We are not liable for any modifications, suspensions, or discontinuations of the Service.

9.3 Instagram Dependency

InstaTracker's functionality depends on Instagram's platform and APIs. If Instagram:

• Changes, restricts, or discontinues their API
• Blocks or restricts InstaTracker's access
• Implements changes that affect data availability

We may need to modify or discontinue features without liability to you. We are not responsible for changes Instagram makes to their platform.

10. Account and Session Management

10.1 Your Responsibilities

You are responsible for:

• Maintaining accurate Instagram login credentials
• Keeping your session secure and confidential
• All activity that occurs under your InstaTracker session
• Promptly updating any changes to your account information
• Notifying us of any security breaches or unauthorized access

10.2 Session Disconnection

You may disconnect your Instagram session at any time through the App's settings. Disconnecting will:

• Remove your session credentials from the App
• Stop all tracking activities
• Optionally delete all stored data (based on your selection)

10.3 Account Suspension or Termination

We reserve the right to suspend or terminate your access to InstaTracker at any time, without prior notice, for:

• Violation of these Terms
• Violation of Instagram's Terms of Service
• Fraudulent, abusive, or illegal activity
• Extended periods of inactivity
• Any other reason at our sole discretion

11. Termination

11.1 By You

You may stop using InstaTracker at any time by:

• Disconnecting your Instagram session through the App
• Uninstalling the App from your device
• Ceasing all use of the Service

11.2 By Us

We may terminate or suspend your access immediately, without prior notice or liability, if:

• You breach any provision of these Terms
• We are required to do so by law
• We decide to discontinue the Service
• Your account has been inactive for an extended period

11.3 Effects of Termination

Upon termination:

• Your right to use the App ceases immediately
• You must delete the App from all devices
• We may delete your account data (if stored on our servers)
• Provisions of these Terms that by their nature should survive termination shall survive (including ownership, warranty disclaimers, indemnity, and limitations of liability)

12. Data Privacy and Security

Your use of InstaTracker is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

13. Third-Party Links and Services

InstaTracker may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for:

• The content, privacy policies, or practices of any third-party sites
• Any damages or losses caused by your use of third-party services
• The availability or functionality of third-party services

We strongly advise you to read the terms and conditions and privacy policies of any third-party sites or services you visit.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. When we make changes:

• We will update the "Last Updated" date at the top of these Terms
• For material changes, we will provide notice through the App, via email, or by other reasonable means
• Your continued use of InstaTracker after changes become effective constitutes your acceptance of the revised Terms
• If you do not agree to the new Terms, you must stop using the App

It is your responsibility to review these Terms periodically for changes. We recommend checking this page every time you use the App.

15. Dispute Resolution

15.1 Informal Resolution

Before filing any formal claim, you agree to contact us at support@instatracker.app and attempt to resolve the dispute informally. We will attempt to resolve the dispute through good faith negotiations.

15.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

15.3 Jurisdiction and Venue

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts located in [Your Jurisdiction], and you hereby irrevocably consent to personal jurisdiction and venue therein.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and InstaTracker regarding the use of the App and supersede all prior agreements and understandings.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid provision will be replaced with a valid provision that most closely reflects the intent of the original provision.

16.3 Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms or any rights hereunder without restriction.

16.5 Force Majeure

We shall not be liable for any failure to perform our obligations under these Terms where such failure results from circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

16.6 Relationship of Parties

Nothing in these Terms shall be construed as creating a joint venture, partnership, employment, or agency relationship between you and InstaTracker.

16.7 Export Controls

The App may be subject to export controls or restrictions by the United States or other countries or territories. You agree to comply with all applicable export control and trade sanctions laws.

17. Feedback and Suggestions

We welcome and encourage you to provide feedback, comments, and suggestions for improvements to InstaTracker. You acknowledge and agree that:

• All feedback you provide is non-confidential and non-proprietary
• We may use your feedback without any compensation or attribution to you
• We have no obligation to implement any feedback you provide
• By providing feedback, you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate your feedback into InstaTracker

BY DOWNLOADING, INSTALLING, OR USING INSTATRACKER, YOU ACKNOWLEDGE THAT YOU HAVE READ THESE TERMS OF USE, UNDERSTAND THEM, AND AGREE TO BE BOUND BY THEM. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE THE APP.
